1. Who we are

Cutly is operated by Essentiala Ltd, a company registered in England and Wales ("we", "us"). By creating an account or using the service you agree to these terms.

2. What the service does

Cutly takes video footage you upload, transcribes it, selects and orders segments, applies colour grading and audio processing, adds captions, and returns a single finished video in 9:16 vertical format.

The service is automated. Output quality depends heavily on the footage you provide, and we do not guarantee that any particular video will be usable, will perform well on any platform, or will meet your expectations.

We may change, add or remove features. If we remove something material to a paid plan, you may cancel and we will refund the unused portion of the period you have paid for.

3. Your account

You must provide a valid email address and keep your login details secure. You are responsible for activity under your account.

One person, one account. Creating multiple accounts to obtain additional free allowance is a breach of these terms and we may suspend accounts used that way.

You must be at least 18, or old enough to enter a contract where you live.

4. Your content and the licence you give us

You keep ownership of everything you upload and everything Cutly produces from it. We claim no rights over your footage or your finished videos.

To provide the service we need a limited licence: you grant us permission to store, copy, transcode, transcribe, analyse and modify your footage strictly for the purpose of producing your video and operating the service. This licence ends when the content is deleted.

You confirm that you have the right to upload what you upload — including the rights to any music, footage, brands or people appearing in it.

5. Acceptable use

You must not use Cutly to process or produce content that:

  • is unlawful, or infringes anyone else’s rights
  • depicts a person without the consent needed where you are
  • is sexual content involving minors, or any other content that is illegal to possess or distribute
  • harasses, threatens or incites violence against anyone
  • is deliberately deceptive in a way likely to cause harm — including impersonating a real person

6. Acceptable use, continued

You must also not attempt to disrupt the service, circumvent quotas or watermarking, reverse engineer it, or resell it as your own product.

We may suspend or terminate accounts that breach this section. Where it is reasonable to do so, we will tell you why and give you a chance to respond.

7. Plans, billing and cancellation

Cutly has a free plan and paid subscription plans. The free plan includes three videos per calendar month and applies a visible watermark to exports. Paid plans include a larger monthly allowance and no watermark; the current allowances and prices are shown on the pricing page.

Payments are processed by Stripe. We do not receive or store your card details. Subscriptions renew automatically until cancelled.

Allowances reset on the 1st of each calendar month and do not roll over.

You can cancel at any time through the billing portal. Cancellation takes effect at the end of the period you have already paid for; you keep access until then and are not charged again. We do not generally refund part-used periods, and this does not affect your statutory rights.

We may change prices. Existing subscribers will be told at least 30 days before a change affects them, and may cancel instead.

8. How long we keep your files

Raw footage you upload is deleted from our systems within 24 hours of processing.

Finished exports are kept for 30 days so you can download them again, then deleted.

Your account details, onboarding answers, usage counts and subscription status are kept while your account is open. See the privacy policy for the detail.

9. Availability

We aim to keep Cutly available but do not promise uninterrupted service. It may be unavailable for maintenance, or because a third party we depend on is down.

The service is provided "as is". To the extent the law allows, we exclude implied warranties.

10. Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Otherwise, our total liability to you in any 12-month period is limited to the amount you paid us in that period. We are not liable for lost profits, lost sales, or lost or corrupted content — keep your own copy of any footage that matters to you.

If you use Cutly for business purposes, you accept that this limitation is reasonable given the price of the service.

11. Changes to these terms

We may update these terms. The "last updated" date above always reflects the current version, and we will notify account holders by email of changes that materially affect them.

Continuing to use the service after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of England and Wales, and disputes will be handled by the courts of England and Wales.

If you are a consumer, you may also have the right to bring proceedings in your own country.
